Terms of Service

1. Introduction and Acceptance
These Terms of Service ("Terms") govern your use of Harmony, a desktop communication application operated by Teragon Technologies LLC ("we," "us," or "our"). By creating an account or using Harmony, you agree to be bound by these Terms and our Privacy Policy.
If you do not agree to these Terms, you may not create an account or use the service.
2. Eligibility
You must be at least 13 years old (or the applicable minimum age in your jurisdiction, such as 16 in some EU member states) to create an account and use Harmony.
By creating an account, you represent that you meet the applicable minimum age requirement and that the information you provide is accurate and complete.
Previously banned users may not create new accounts to circumvent enforcement actions.
3. Your Account
You are responsible for maintaining the security of your account credentials and for all activity that occurs under your account. You agree to:
- Choose a strong password and keep it confidential
- Not share or sell your account credentials
- Notify us immediately if you suspect unauthorized access to your account
We are not liable for any loss or damage arising from unauthorized use of your account.
4. Description of the Service
Harmony is a free desktop communication application providing text channels, voice chat, video calls, and screen sharing. It is available on Windows, macOS, and Linux.
Harmony is provided free of charge. We do not guarantee any specific level of uptime, availability, or performance. We reserve the right to modify, add, or remove features at any time.
5. Your Content
You retain ownership of all content you create, including messages, files, and images you share through Harmony.
By posting content, you grant Teragon Technologies LLC a limited, non-exclusive license to store and transmit your content solely for the purpose of operating the service. We do not claim any broader rights to your content and will not use it for any other purpose.
You are responsible for ensuring that:
- Your content is lawful and does not violate any applicable laws or regulations
- You have the necessary rights to share any content you post
- Your content does not infringe on the intellectual property rights of any third party
6. Intellectual Property
All intellectual property in Harmony — including the application design, logo, branding, and source code — belongs to Teragon Technologies LLC.
You receive a limited, non-exclusive, non-transferable, revocable license to use the Harmony application for personal communication purposes. You may not:
- Reverse engineer, decompile, or disassemble the application
- Redistribute, sublicense, or commercially exploit the application
- Remove or alter any proprietary notices or branding
7. Prohibited Conduct
You agree not to use Harmony to:
- Engage in or facilitate any illegal activity
- Harass, abuse, threaten, or intimidate other users
- Impersonate other users or Teragon Technologies LLC staff
- Send spam, mass unsolicited messages, or automated abuse
- Distribute malware or attempt to compromise other users' systems or accounts
- Attempt to circumvent security measures or gain unauthorized access to systems
- Share private information of other users without their consent
- Use the service in any manner that violates applicable laws or regulations
8. Server Owners and Administrators
If you create a server on Harmony, you are responsible for the community you build. Server owners and administrators must ensure their communities comply with these Terms.
We reserve the right to remove servers, content, or administrators that violate these Terms. Server ownership does not grant any special rights over user data or Harmony's systems.
9. Termination
- By you: You may delete your account at any time through the application settings.
- By us: We may suspend or terminate your account for violations of these Terms, with or without prior notice depending on severity.
- Effect: Upon termination, your access is immediately removed and your data is deleted according to the retention schedule described in our Privacy Policy.
The following sections survive termination: Intellectual Property, Disclaimer of Warranties, Limitation of Liability, Indemnification, and Governing Law.
10. Disclaimer of Warranties
Harmony is provided "as is" and "as available" without warranties of any kind, whether express or implied. We do not warrant that the service will be uninterrupted, error-free, or free of harmful components.
We make no warranties regarding fitness for a particular purpose, data preservation, or the accuracy of any information provided through the service.
11. Limitation of Liability
To the maximum extent permitted by applicable law, Teragon Technologies LLC shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of Harmony.
Since Harmony is provided free of charge, our total aggregate liability for any claims arising from or related to the service shall not exceed one hundred U.S. dollars (USD $100).
We are not liable for user-generated content, actions of other users, third-party service interruptions, or data loss due to factors outside our direct control.
12. Indemnification
You agree to indemnify and hold harmless Teragon Technologies LLC and its officers, directors, and employees from any claims, damages, losses, and costs (including reasonable legal fees) arising from your use of the service, your content, or your violation of these Terms.
13. Governing Law and Dispute Resolution
These Terms are governed by the laws of the State of Texas, United States, without regard to conflict of law principles.
We encourage you to contact us first to resolve any disputes informally. If a dispute cannot be resolved informally, it shall be resolved in the courts located in the State of Texas.
We do not require mandatory arbitration. We believe you should have the right to pursue claims in court if needed.
14. Changes to These Terms
We may update these Terms from time to time. Material changes will be communicated via in-app notification or email at least 30 days before taking effect.
Continued use of Harmony after the effective date of updated Terms constitutes your acceptance of the changes.
15. General Provisions
- Entire Agreement: These Terms, together with our Privacy Policy, constitute the entire agreement between you and Teragon Technologies LLC regarding your use of Harmony.
- Severability: If any provision of these Terms is found to be invalid or unenforceable, the remaining provisions remain in full force and effect.
- No Waiver: Our failure to enforce any provision of these Terms does not waive our right to enforce it in the future.
- Assignment: We may assign our rights and obligations under these Terms in connection with a business transfer. You may not assign your account or rights under these Terms.
